CALIFORNIA JUDICIAL COUNCIL
TheĀ California Judicial CouncilĀ is the constitutionally established, policymaking body for the California Courts, the largest judicial system in the United States. Under the leadership of the Chief Justice of California, it is responsible for ensuring the consistent, independent, impartial, and accessible administration of justice.
Structure and Membership
The Judicial Council is chaired by the Chief Justice of California. Its membership is diverse and includes representatives from all levels of the legal system, appointed for three-year terms to ensure continuity and fresh perspectives.
The 21 voting members consist of:
- The Chief Justice
- One other Justice of the Supreme Court
- Three Justices of the Courts of Appeal
- Ten judges of superior courts
- Four members of the State Bar appointed by its governing body
- One member of the State Senate and one member of the State Assembly
The Judicial Council also includes several nonvoting advisory members, such as court executives and administrators. Members act in the best interest of the statewide judicial system and the public, rather than as representatives of a specific constituency.
Key Responsibilities and Functions
The Judicial Council performs its functions with the support of its staff (the Administrative Office of the Courts), undertaking a broad range of responsibilities to support the state’s 58 superior courts and appellate courts. Its primary functions include:
Policymaking and Strategic Planning:Ā Setting the direction and priorities for the judicial branch to improve the administration of justice. This involves developing long-range strategic plans and operational plans.
Adopting Rules and Forms:Ā Adopting and revising the California Rules of Court, as well as developing official court forms and jury instructions to ensure uniform procedures across the state.
Court Administration and Infrastructure:Ā Establishing standards for court operations and procedures, managing court facilities (including construction projects), and overseeing the development of administrative and technological infrastructure.
Budgeting and Funding:Ā Advocating for adequate, stable, and predictable funding for the judicial branch and allocating the state trial court funding to individual courts.
Ensuring Access and Fairness:Ā Developing programs and policies to remove barriers to justice, increase public access, and ensure fairness and diversity within the court system and the bench itself.
Education and Training:Ā Providing high-quality education and professional development for judges and court staff.
Through these functions, the Judicial Council ensures that the California court system operates efficiently, effectively, and consistently, upholding the rule of law and protecting the rights and liberties of the public.
